An arbitrator has determined that Brevard Public Schools does not have to rehire a teacher who was terminated last year, according to a decision released this week. The ruling comes after the teacher filed a complaint alleging unfair dismissal related to contract terms. The school district said it will comply with the arbitrator’s decision.
The teacher, identified only as Jane Doe in public records, was let go in June 2023 following a dispute over performance evaluations and classroom management policies. She argued the termination violated her contract, which included provisions for due process. The case was heard by an independent arbitrator appointed through the Florida School Boards Association.
Brevard Public Schools officials said the district respects the arbitrator’s findings and will not pursue reinstatement. 'We believe the decision is fair and based on the evidence presented,' said Superintendent Randy Neugebauer in a statement. The school board has not yet commented on potential policy changes related to teacher contracts.
Doe’s attorney said the ruling is a 'partial victory' but noted the teacher will review the decision for possible appeals. 'We’re disappointed the arbitrator didn’t address the broader issues of workplace discrimination,' the attorney added. The case has drawn attention from local educators, though no formal protests have been reported.
The arbitrator’s decision is final unless appealed within 30 days. The teacher has until then to challenge the ruling in court. The case highlights ongoing tensions between school districts and educators over contract disputes in Brevard County.
